This Privacy Policy explains how Foamex Group Pty Ltd, together with its related bodies corporate, brands, divisions, websites and authorised representatives, collects, holds, uses and discloses personal information in the course of its business activities.
In this Privacy Policy, the terms “Foamex”, “we”, “us” and “our” refer to Foamex Group Pty Ltd and, where the context permits, its related bodies corporate, business units, brands, employees, contractors, agents and authorised service providers.

- Foamex websites, product websites, microsites and landing pages;
- download forms, contact forms, product enquiry forms, sample requests, quote requests and technical documentation requests;

- digital advertising campaigns and social media pages;
- customer relationship management (CRM) and marketing automation systems;
- supplier, distributor and contractor relationships; and
- recruitment and employment enquiries.
This Privacy Policy also applies to Foamex product, campaign and brand websites that link to this policy, including product information pages and microsites for individual Foamex solutions.
Where a separate privacy notice or collection statement is provided to you at the time information is collected, that notice should be read together with this Privacy Policy.

Foamex respects your privacy and is committed to handling personal information responsibly, transparently and in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
We aim to collect only the personal information reasonably necessary for our business operations, including supplying products, responding to enquiries, managing customer relationships, providing technical information, improving our websites, supporting digital marketing activities, and communicating with customers, builders, architects, designers, engineers, specifiers, concreters, contractors, distributors, suppliers and other industry contacts.

What Personal Information We Collect
The personal information we collect depends on how you interact with us and the nature of your enquiry or relationship with Foamex. We may collect the following kinds of information.
3.1 Contact Information
- name, business name and job title;
- email address, phone number and mobile number;
- postal address, delivery address, state or territory, postcode and country;
- preferred contact method.
3.2 Business and Project Information
- company name, industry or business type, role or profession;
- product interest, project type, project location and project timing;
- building or construction requirements, technical enquiry details and specification requirements;
- sample requests, quote requests, order history and customer service records;
- communications with our team.
3.3 Website and Digital Information
When you use our websites, landing pages or digital content, we may collect:
- IP address, browser type, device type and operating system;
- approximate location, pages viewed, time spent on pages and links clicked;
- forms started or submitted, files downloaded, referring website and advertising campaign source;

This includes forms used to request product packs, brochures, whitepapers, technical data sheets, samples, quotes, sales contact, newsletters or other Foamex resources.
3.5 Marketing and Communication Preferences

- advertising consent preferences and records of communications sent to you;
- records of whether you opened or clicked marketing emails (where this is enabled);
- records of your interactions with Foamex digital campaigns.
3.6 Customer, Supplier and Transaction Information
If you are a customer, supplier, distributor, contractor or other business contact, we may collect:
- quote, order, invoice and delivery information;
- account information, payment-related records and credit account application information;
- supplier or contractor records and product supply records;
- warranty and technical support information;

If you apply for employment, work experience, a contractor role or another opportunity with Foamex, we may collect:

3.8 Sensitive Information
We do not generally seek to collect sensitive information through our websites or product enquiry forms.
Sensitive information includes information about your health, racial or ethnic origin, political opinions, religious beliefs, union membership, criminal record or biometric information.

- request a product pack, downloadable resource, quote or sample;
- make a product, technical, sales or project enquiry;

- place an order or apply for a trade or credit account;
- attend a trade show, event, presentation or demonstration;
- interact with our digital advertising or social media pages;
- apply for employment or contractor opportunities with Foamex.
In some circumstances, we may also collect personal information from third parties, including:
- builders, architects, engineers, specifiers, contractors and project partners;
- distributors, stockists, suppliers and referral partners;

- provide quotes, sales support and technical advice or product guidance;
- assess product or project requirements;
- manage customer, supplier, contractor and distributor relationships;
- process orders, deliveries, invoices and account administration;
- provide customer service, warranty support and after-sales assistance;
- maintain business records and manage our CRM systems, including Salesforce;
- manage Salesforce Marketing Cloud Account Engagement (formerly Pardot) activity;

Product Websites, Microsites and Landing Pages
Foamex may operate or use product-specific websites, microsites and landing pages, including pages dedicated to specific products, campaigns or downloadable resources.
Where a product website or campaign page links to this Privacy Policy, the personal information collected through that website or page will be handled in accordance with this Privacy Policy.
For example, if you submit a product pack request, technical resource request or product enquiry form, Foamex may use your details to send the requested information, respond to your enquiry, record the enquiry in our CRM, attribute the enquiry to the relevant advertising campaign, and follow up with you regarding related product or project needs.

Salesforce CRM and Marketing Cloud Account Engagement (Pardot)
Foamex uses Salesforce CRM and Salesforce Marketing Cloud Account Engagement (formerly known as Pardot) to manage enquiries, leads, customer relationships, sales activity, campaigns, marketing communications, website engagement and product resource requests.
When you submit a website form, your information may be transmitted to Salesforce so that Foamex can:
- respond to your enquiry and send the materials you have requested;
- manage follow-up communications;
- record your product interests;
- manage sales and technical communications;
- attribute enquiries to marketing campaigns; and
- manage marketing consent and unsubscribe preferences.
Where Salesforce Account Engagement tracking is used, it may help Foamex understand engagement with our websites, landing pages, emails and campaigns. Salesforce tracking technologies may use cookies or similar technologies, which will generally be treated as analytics or marketing technologies and managed through our cookie consent settings where appropriate.

Direct Marketing Communications
Foamex may use your personal information to send marketing communications about Foamex products, services, technical resources, sustainability information, case studies, industry updates, events, offers and related business information.

Tracking pixels may collect or transmit information such as IP address, device information, browser information, page URL, referring website, pages viewed, button clicks, form events, campaign identifiers, cookie IDs and advertising identifiers.
We use these technologies to measure advertising performance, understand campaign effectiveness, record conversions and support relevant advertising. We do not intend to use tracking pixels to collect sensitive information.
Where available, we provide cookie controls so that visitors can reject or manage non-essential tracking technologies.

Google, LinkedIn, Meta and Search Advertising
We use Google Analytics and Google Ads to improve our website experience and deliver relevant advertising. By using this site, you acknowledge our use of these tools for performance and advertising purposes. Foamex also use advertising and analytics services provided by social platforms such as LinkedIn and Meta. These services may help Foamex to:

- show relevant advertising and limit irrelevant advertising; and
- measure return on marketing activity.

- analytics providers, advertising platforms and social media platforms;
- payment, finance, credit and account administration providers;
- freight, delivery and logistics providers;
- professional advisers, including lawyers, accountants, auditors and insurers;
- recruitment and human resources service providers;
- government authorities, regulators or law enforcement bodies, where required or permitted by law; and
- other parties where you have consented to the disclosure or where the disclosure is otherwise permitted by law.
Foamex does not sell personal information to unrelated third parties.

Overseas Disclosure
Some service providers, technology platforms, CRM systems, cloud hosting providers, analytics providers and advertising platforms used by Foamex may store, process or access personal information outside Australia.
The countries in which overseas recipients are located may vary depending on the provider and its systems, and may include the United States and other countries in which our service providers or their sub-processors operate.
Where personal information is disclosed overseas, Foamex will take reasonable steps required by Australian privacy law to ensure that the overseas recipient handles the information in accordance with the Australian Privacy Principles, unless an exception applies.

Foamex takes reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps may include:

- restricted CRM access;

- security monitoring and system maintenance;

While we aim to apply technical and organisational safeguards appropriate to the nature of the information we hold, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.

Retention of Personal Information
Foamex retains personal information for as long as is reasonably necessary for the purpose for which it was collected, including to:
- respond to enquiries and manage customer relationships;
- supply products and services;
- maintain business records;

- maintain CRM records and campaign history.
When personal information is no longer required, we will take reasonable steps to destroy, delete, de-identify or securely archive it, subject to our legal and business record-keeping obligations.

In some circumstances, we may decline access or correction where permitted by law. If we decline a request, we will provide written reasons for our decision and inform you of the available complaint mechanisms, unless it would be unreasonable or unlawful to do so

You may opt out of Foamex marketing communications at any time by:

Foamex may collect information that you make available to us through social media interactions, such as comments, messages, enquiries, profile information, and engagement with our posts and advertisements.

Children
Foamex websites, products and services are intended for business, construction, building, design, engineering, architectural, trade and adult consumer audiences.
We do not knowingly collect personal information from children through our websites. If you believe that a child has provided personal information to us, please contact us so that we can review and, where appropriate, delete that information.

Automated Decision-Making
Foamex may use technology systems to assist in managing enquiries, recording campaign engagement, segmenting marketing lists, prioritising follow-up activities and improving customer communications.
